Q. How are onsite interviews
handled? |
|
A.
CCMI
schedules one date each month to job
walk projects and randomly interviewing
employees. The project manager will be
notified a few days ahead of time. This
is to ensure that we do not interrupt
any part of the project, such as a
concrete pour. A few employees will be
selected randomly and interviewed for a
couple minutes. This information is
then checked with the certified payrolls
submitted by the contractors.

Q. The entity says they are exempt
from prevailing wages. Is that
true? |
|
A. In
very limited circumstances this may be
true. This only applies to “Charter
Cities” who are using only local funds
(no State or Federal Funds) and have
passed a law to exclude a project from
prevailing wages. The only other
exception is when a public entity which
has a Labor Compliance Program set up to
monitor all public works projects – can
exempt small ticket jobs only. This can
be a complicated area so make sure you
have all of the facts confirmed in
writing and you may want to contact your
legal council.

Q. I am a sole proprietorship or
partnership. Do I still need to
submit certified payrolls? |
|
A.
Yes.
In 1997, the Department of Industrial
Relations and the California Courts
confirmed that any individual who
performed work on the project must be
paid prevailing wages, submit certified
payroll and comply with Labor Code 1720
et seq.

Q. What if I do not want to use
apprentices? |
|
A. All
employers (with the exception of a sole
proprietor who has no employees) are
required to complete and submit DAS-140
and DAS-142 Forms.
